Cancellation & Refunds
Cancellation of any monthly recurring service can occur at any time after your first 1 month (30 days) of service. No Refunds are available after your purchased package or service has been started, unless otherwise specified or authorised by Weave.
Cancellations by emailing us at email@example.com. Your hosting will remain in place until the end of the billing period you have paid for.
You will only use Weave’s hosting services for lawful purposes and You will not store or provide any Content or User Content or link to any material that violates any foreign or NZ law.
Unless selected with this plan, Website backups are Your responsibility. Weave is not responsible for lost Content or lost User Content. Scheduled website backups are an “add-on” service and will require a separate agreement. They come as standard with our Monthly Care Plans.
If you have selected a backup plan, Daily backups will be held for 30 days. A restore from a backup will take about 5 mins once initiated. Please lodge a support ticket at http://weavedigital.support or email us at firstname.lastname@example.org.
Updates & Maintenance
You are responsible for maintaining WordPress (or whichever software platform your site runs on) and keeping it up to date along with all the plugins which keep the site functioning.
We will help with this as much as we can by sending emails out when we know of important updates and hacks which need patching or when new versions are released.
Moving Your Hosting
There is no cost to move between our plan options or to move up to one of our Care Plans.
The cost for bundling all your files and database up for you in a archive to move to your own hosting is $300 +gst.
Premium Plugins. Your website may have been built using premium plugins or extensions to add needed functionality to your website. Some we install using our Developer license at no cost to you. Others require yearly license renewal fees per website to keep the code updated and secure. If you select not to partake in a monthly website care plan or our hosting, you will be invoiced/billed for the renewal fees of any premium plugins used to build your website not covered by our developer license after the first year. If you select not to renew the license we cannot be responsible for any functionality or security issues this may cause in the future. We we remove our licences before giving you these files and let you know what you need to organise.
Pricing & Payments
All prices are in New Zealand Dollars. Prices appearing on this site are subject to change without notice. Billing is in advance for services. Once a client of Weave, you authorise Weave to charge the payment method you submitted for all the invoices generated for the services rendered by Weave. In order to cancel your recurring payment or change payment method, simply contact Weave prior to your payment’s due date. Weave may, at its option, charge a 10% fee for late payments, although we hope we don't have to.
You are engaging Weave, as an independent contractor to perform work as described in the package(s) or service(s) you have purchased. In the event access to your website is necessary, you hereby authorise Weave access and “write permissions” to all directories and files of your account with any other third party hosting provider, as well as permission to install any necessary WordPress plugins for maintenance and security.
Weave does not assume any responsibility or liability for the content of the websites it manages, maintains and/or hosts.
Weave’s services will conform to the following:
Availability of Website - Weave will provide hosting services for the Website that meet reasonable commercial standards for, among other matters, packet loss, accessibility, latency, availability, and throughput.
Security - Weave will take commercially reasonable steps to prevent unauthorised access to the Website, Content, User Content, and Confidential Information stored on Weave’s server computers.
Server/Network Computer Outages - Weave will employ best efforts in providing advance notice to Customer of scheduled server computer/network outages.
Refusal of Service
Weave reserves the right to refuse service to any individual, website, or blogs that contain offensive, obscene, hateful, malicious content or any other reason.
Termination by Weave.
Weave may terminate this Agreement without cause at any time upon thirty (30) days written notice to You.
Limitation of Liability; Disclaimer of Warranties
Although there are limitations to the guarantees we can provide, your satisfaction is very important to us. Please read and understand our limits of liability before ordering services.
Weave does not guarantee, represent, or warrant that the functions contained in these webpages or the Internet website will meet the client's requirements or that the operation of the webpages will be uninterrupted or error-free.
You expressly agree that your use of, or inability to use, the functions contained in these webpages or the Internet website is at your sole risk. The functions of the webpages and the Internet website created for you are provided “as is” and “as available” for your use, without warranties of any kind. The entire risk as to the quality and performance of the webpages and website is with client.
To the extent not prohibited by law, in no event will Weave be liable to the client or any third party for any damages, including, but not limited to, any lost profits, lost savings, loss of data, business interruption, or incidental, consequential or special damages arising out of the operation of or inability to operate these webpages or website, however caused, even if Weave has been advised of the possibility of such damages.
Weave does not represent, guarantee or warrant that the functions contained in these webpages or Internet website will be free from loss, corruption, attack, viruses, interference, hacking, or other security intrusions, and Weave disclaims any liability relating thereto.
This Work Statement Agreement is governed by the laws of New Zealand without giving effect to its conflict of laws provision. You expressly agree that exclusive jurisdiction for any claim or dispute with Weave or relating in any way to your use of the created webpages or Internet website resides in the courts of New Zealand.
Please note that by submitting your payment, you are agreeing to all of our terms of service as they are written here. Weave reserves the right to change or update these terms at any time without prior notice. The user of this site agrees to the terms of this agreement on behalf of his or her organisation or business. This Agreement constitutes the entire understanding of the parties. Any changes or modifications thereto must be in writing and signed by both parties.
This contract cannot be transferred to anyone else without our permission. This contract stays in place and need not be renewed. If for some reason one part of this contract becomes invalid or unenforceable, the remaining parts of it remain in place. Although the language is simple, the intentions are serious and this contract is a legal document under exclusive jurisdiction of the courts of New Zealand.
